Judge Elizabeth Metzger of Florida’s 19th Circuit Court ruled on Wednesday that Herman’s claims of the NDA being invalid and unenforceable were not convincingly presented.

Herman’s lawyers argued against the validity of the Non-disclosure agreement (NDA) due to allegations of sexual harassment against Tiger Woods, asserting that he engaged in a sexual relationship with her while she was working for him and then coerced her into signing the NDA under the threat of job termination. However, Judge Metzger’s ruling permits the arbitration process to proceed confidentially in accordance with the terms of the agreement.
Herman sought to void the arbitration agreement under a new federal law that allows such agreements to be invalidated if they involve sexual misconduct. However, Judge Metzger stated that Herman had not provided sufficient specific evidence or details regarding any claim of sexual assault or harassment.
Woods’ legal team countered Herman’s allegations
Describing them as implausible and arguing that her claims did not meet the legal requirements for sexual harassment under federal, tribal, or state law. They asserted that Herman had failed to present a cause of action reaching the necessary threshold.
With the judge’s decision, the dispute between Tiger Woods and his ex-girlfriend will proceed through the arbitration process, maintaining the privacy and confidentiality outlined in the NDA.
