Declared to be unconstitutional: DACA

A Texas court has ruled that the expanded Deferred Action for Childhood Arrivals (DACA) program from the Biden administration is unlawful. The same court had already declared the original DACA to be unconstitutional.

The judge declared the program unlawful for several reasons, including the fact that DACA was not established through an official agency procedure, the Obama administration exceeded its bounds by bypassing Congress, the legislation was not entitled to the necessary public comment and notification periods, etc.

Texas and five other states filed a lawsuit in 2018 to have DACA overturned because they claimed it caused harm to their jurisdictions. The judge upheld the state’s position and permitted the case to go on.
