Bystanders informed the U.S. military vet who was seen choking Jordan Neely on the New York City subway last week saying that he was “attempting to murder” the homeless Black guy who eventually lost awareness and was declared deceased at a hospital.

A former senior law enforcement officer named Daniel Penny, 24, of West Islip, Long Island, the veteran, according to Insider’s publication on Friday. Based on cops and eyewitnesses Neely, a 30-year-old homeless Michael Jackson impersonator, had been walking and shouting while on a F train in Manhattan on Monday afternoon before a few others grabbed and detained him.

Freelance journalist Juan Alberto Vazquez shared a video of the event on the internet, revealing Penny laying beneath Neely and holding him under a chokehold for a long time. Neely struggled to escape as two other passengers restrained both of his arms and shoulders.
