The University of North Texas is justified in charging out-of-state residents more for tuition than it does for in-state illegal aliens, according to the conservative 5th Circuit US Court of Appeals. Young Conservatives of Texas did not contest the state’s different policy of establishing residence requirements, which classifies such immigrants as in-state residents when they live in Texas.

The student group has a range of alternatives at its disposal. It has two options: resubmit the lawsuit in a more focused form or appeal to the full 5th Circuit. The possibilities are endless, claims Henneke.
