Wendy has been sued for taking the fingerprint biometrics of employers without following privacy laws, and because of that Illinois Settlement Claims will be available to qualified individuals.
According to Top Class Actions, Wendy’s has not confessed to any violation but agreed to pay $18.2 million Illinois Settlement Claims to resolve the issue.
Illinois Settlement Claims was given because Wendy’s employees were allegedly required to scan their fingerprints in a fingerprint point of sale system between September 11, 2013, and November 29, 2023. The state has forbidden it under its privacy law.

While there are tremendous benefits to using biometric time clocks in the workplace, there are also serious risks. If a fingerprint database is hacked and exposed, employees have no means by which to prevent identity theft and unauthorized tracking.
