Who Can Receive VA Burial Benefits?
Eligibility for VA funeral benefits depends on several factors, including the veteran’s service record and circumstances surrounding their death.
- Immediate Family Members: Surviving spouses, legally recognized partners, children, parents, or the executor of the veteran’s estate are eligible to apply.
- Service Requirements: The veteran must have been discharged under conditions other than dishonorable.
- Circumstances of Death: Benefits are available if the veteran:
- Died from a service-connected disability.
- Passed away while under VA care, including at a VA hospital or contracted facility.
- Was traveling under VA authorization for treatment at the time of death.
- Had a pending VA pension or compensation claim at the time of death.
Who Is Not Eligible?
Certain cases are excluded, such as veterans who died on active duty, individuals serving as members of Congress, or those serving a federal prison sentence.
What Does the Benefit Cover?
Families may receive several types of assistance:
- Funeral and Burial Costs: A set monetary amount to help cover the expenses.
- Plot Allowance: Funds to assist with the cost of a burial plot or interment.
- Transportation Costs: Reimbursement for transporting the veteran’s remains to their final resting place.
The VA also supports cremations, burials at sea, and cases where remains are donated to medical research.
How to Apply for VA Burial Benefits
Applying is straightforward but requires certain documentation:
- Gather Required Documents: You’ll need the veteran’s death certificate, DD214 (discharge papers), and receipts for funeral or transportation costs.
- File Your Claim: Submit VA Form 21P-530EZ online at the VA website or mail it to the VA Pension Intake Center in Janesville, Wisconsin.
Claims for non-service-connected deaths must be filed within two years of the veteran’s burial. There’s no time limit for service-connected deaths. Surviving spouses listed on the veteran’s profile may automatically receive benefits without needing to apply.
