Jose Leonardo Marquez, a machete-wielding man, was arrested outside the Capitol on December 26. Venezuelan illegal immigrant 23-year-old detained on August 21, 2022, entered the U.S. through El Paso, Texas. Border patrol released Marquez due to a “lack of detention capacity” and put him in the “Alternatives to Detention” tracking program.

U.S. Capitol Police approached Marquez because of his suspicious conduct and found a brick in his pocket, which he threw away at the officer’s request. A knife on a Capitol ledge and a handle under his clothes were found. The officer grabbed his revolver, told Marquez to raise his hands, and found a machete on him after asking for backup.

Marquez faced charges of Carrying a Dangerous Weapon and Possession of proscribed weapons. ICE said Marquez reported to ERO Washington, D.C. on October 5, 2023. His custody is with ICE ERO Washington, D.C.

ICE said Marquez was released sooner due to custody capacity issues, underlining immigration authorities’ limitations. ERO Washington, D.C. acting Field Office Director Patrick Divver stressed Marquez’s warning to Capitol residents. Divver praised the U.S. Capitol Police for quickly containing the threat.
