According to the Manhattan district attorney’s office, Daniel Penny is expected to be detained for the suffocating death of Jordan Neely on Friday.
Manslaughter in the 2nd degree will be Penny’s indictment.
Penny is anticipated to turn herself into police on Friday morning, sources say CBS2. After his hearing at Manhattan Criminal Court, the judge will decide if to issue bail or not.
Penny could spend as much as 15 years in jail if proven guilty.
The Manhattan district attorney issued Thursday second-degree manslaughter allegations for Penny, the 24-year-old Marine veteran videotaped keeping Neely in a suffocating position on the subway for about 3 minutes on May 1. This comes 10 days after Neely passed and over a dozen protests afterward.
Police interrogated Penny before releasing her without filing any charges.
Later, the coroner’s office determined that Neely’s death was a homicide.
