Illinois Gun Owners Granted Registration Option for Prohibited Firearms Under New Law

In a significant development for Illinois Gun Owners, the state has introduced a registration process for firearms now prohibited for sale or purchase under the newly enacted assault weapons ban, officially titled the Protect Illinois Communities Act from Illinois gun owners.

This law encompasses the prohibition of “assault weapons,” as well as associated attachments, .50 caliber rifles, cartridges, and high-capacity magazines for Illinois gun owners

However, Illinois gun owners who already possessed these items prior to the ban’s enforcement must submit an endorsement affidavit through their Firearm Owner’s Identification Card (FOID) account by January 1, 2024. The Illinois State Police (ISP) recently filed emergency rules to implement this aspect of the ban, effective next month. The Illinois gun owners, containing essential information such as the applicant’s name, birthdate, FOID card number, and weapon details, must be submitted online via the FOID Card account. ISP will commence accepting these affidavits online from October 1.

This law was enacted in reaction to a devastating mass shooting event that occurred in Highland Park last year, prompting the General Assembly to take action. Despite facing immediate legal challenges claiming Second Amendment infringements, it was eventually upheld by the Illinois Supreme Court, benefiting Illinois gun owners. However, a definitive decision is still pending issuance, as it awaits the plaintiffs’ appeal to the U.S. Supreme Court.
