The utilization of an out-of-district grand jury by special counsel Jack Smith to carry out his investigation is being questioned by the judge presiding over the case involving secret papers involving former president Donald Trump.
Even though Trump was previously accused on charges by a different grand jury impaneled in Florida, U.S. District Judge Aileen Cannon is pressing Smith to explain why his office used a different grand jury to allegedly continue its investigation into the claimed dealing of classified documents after Trump left office.
The new development was a result of a harsh decision made by Judge Cannon on Monday morning when she commanded the removal from the record of 2 secret submissions made by Smith on her court.
The documents were related to a motion Smith’s team made last week asking for an inquiry on possible disputes of interest that may exist because Walt Nauta, a Trump supporter, and co-defendant who is accused in the indictment alongside Trump, has an attorney who also represents additional possible witnesses who might be used as witnesses against Nauta.
