The Arizona lawmakers and relatives of the murder suspect who killed his mother and niece in 1999 are questioning the controversial release of the murder suspect from the Arizona psychiatric hospital.

The family members of the murder suspect are questioning the Mental facility on the controversial release of the murder suspect

Lawmakers and the nephews of Rodney Aviles spoke to the press following the controversial release of their murder suspect uncle on July 20, 2023

Aviles, the murder suspect, was arrested and charged with the murder in killing his mother Mauricia Aviles, and his young niece Alea in 1999. The murder suspect never went to trial because the court ruled him incompetent and not restorable.

The murder suspect has been admitted to the Arizona State Hospital for 24 years. In three cases, the murder suspect was released and then civilly back to the mental hospital.

The prosecutors tried to prosecute the murder suspect three times, but the court found him incompetent to stand trial in 1999, 2006, and 2010.

The release of the murder suspect mandated by a court order

Arizona Department of Health Services said that the murder suspect is under a Title 36 order for treatment, which means the murder suspect is a must patient to receive treatment, and under the least restrictive means.

Court documents also show that a doctor wrote in 2019 that the murder suspect patient is expected to need inpatient care for his whole life barring a medical breakthrough.

Lawmaker Anthony Kern said last Monday that the public is at risk because the public does not know where the murder suspect was released or what the murder suspect looks like.
